OFFICIAL RULES FOR CLUB E PHOTO CONTEST

  1. NO PURCHASE NECESSARY.

  2. NO PURCHASE OR PAYMENT OF ANY KIND REQUIRED TO ENTER OR WIN A PRIZE. Entrants do not have to purchase any products. VOID WHERE PROHIBITED OR OTHERWISE RESTRICTED BY LAW. The Contest is subject to all federal, state and local taxes, statutes and regulations.

  3. PARTICIPATION CONSTITUTES ACCEPTANCE OF RULES. Participation in this Contest constitutes entrant’s full and unconditional acceptance of (i) these Official Rules and (ii) the terms and conditions of the User Agreement of the United States Equestrian Federation, Inc. Club Equestrian Website. The Contest is sponsored by the United States Equestrian Federation, Inc., 4047 Iron Works Parkway, Lexington, KY 40511 (“Sponsor”). By submitting a photograph for publication, entrant certifies that he/she has the legal right to reproduce, display, transmit and publish it, as well as assign such right.

  4. HOW TO ENTER. Log in to ClubEquestrian.com using your username and password. Once logged in, you can click on “Enter Photo Contest” from your “Tools Menu.” Entries for the Contest will be taken from the first day of the month until the end of the day on the 17th of the month. All Internet access and usage charges are the responsibility of the entrant. If for any reason the Internet portion of the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right at its sole discretion, to terminate, modify or suspend the Contest. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alternation of, entries. Sponsor is not responsible for any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Contest. In the event of a dispute, eligible electronic entries will be considered made by authorized account owner of the e-mail address submitted at the time of entry. Sponsor reserves the right to remove any photos that do not fit the contest theme, are inappropriate in nature, or may infringe on copyright.

  5. VOTING

    Entries may be submitted the first day of the month until the end of the day on the 17th of the month. USEF will select finalists from the entries. Voting on these finalists will begin on the 19th of the month and run through the end of the last day of the month.

  6. PRIZE

    The prize for each Contest month will be displayed on the Contest section of the website, www.ClubEquestrian.com, and will not exceed a value of $500.00.

  7. WINNER

    The monthly winner of the Contest will be based on the photo with the most votes from ClubEquestrian members at the end of the Contest from all eligible entries received by Sponsor, whose decisions regarding all aspects of the Contest shall be final and binding. Voting will end on the last day of each Contest month. In the event of a tie, those photos tied with the most votes will be put before a three-judge panel chosen at the discretion of the Sponsor.

    Winners acknowledge that except and to the extent that the Sponsor cannot by law exempt itself from responsibility or liability, the Sponsor has neither made nor is in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prizes described herein including, but not limited to, its quality, merchantability, mechanical condition or fitness for use. All warranties are hereby disclaimed, and the winner will accept the prize “as is.” All federal, state and local taxes, fees and other expenses not specified herein (including, without limitation, sales tax, luxury tax and any other costs incurred in claiming or using any of the prizes), are the prize winner’s sole responsibility. Prizes cannot be assigned, transferred, exchanged or redeemed for cash. No prize substitution or cash equivalent of prize, except at Sponsor’s sole discretion, and then only for a prize of equal or greater value.

    Potential winners will be notified by email or telephone, within 10 days of the last day of each Contest month. If any potential winner declines to accept the prize or cannot be contacted within 10 business days of the end of the contest by the email address or telephone number supplied upon registration on ClubEquestrian.com, such potential winner will be disqualified and the Sponsor will award the prize to the entrant with the next highest number of votes. In the event of a tie, those photos tied with the most votes will be put before a three-judge panel chosen at the discretion of the Sponsor. By participating, entrants release United States Equestrian Federation, Inc., and their members, officers, directors, employees and agents of each from any and all liability, damages or causes of action (however named and described) for injuries, damages or losses to persons or property which may be sustained in connection with receipt, enjoyment, ownership or use of any prize. By acceptance of prize, winner grants permission to Sponsor to use winner’s name, age, city, state, photograph or likeness and the photo selected as the winning photo for advertising and promotional purposes without additional compensation or approval (where lawful). Sponsor reserves the right to cancel the Contest at the end of any month.

  8. ELIGIBILITY: The Contest is open to legal residents of the United States. Employees of the United States Equestrian Federation, Inc., are not eligible to win.

  9. WINNERS: To obtain a winner’s list, send a self-addressed, stamped business size (#10) envelope to: Sarah Evers, Director of E-Communications, United States Equestrian Federation, 4047 Iron Works Parkway, Lexington, KY 40511.

  10. DISPUTES: By participating, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or in connection with this Contest, or any prizes awarded shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the Commonwealth of Kentucky; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorney’s fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental and consequential damages, and any other damages other than out-of-pocket expenses and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, to the extent that such issues and questions are not subject to the statutes or regulations of another state or locality, shall be governed by, and construed in accordance with the laws of the Commonwealth of Kentucky, without giving effect to any choice of law or conflict of laws or provisions (whether of the Commonwealth of Kentucky or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the Commonwealth of Kentucky.
